Conditions for Bidding and Stallion Contract
Offer: 2 (5 ml vials) of Frozen Semen from Silver Granite (RID 762)
From the 1994 Stallion Importation Collection owned by James
McGinty , here in after known as Semen Owner, will be provided to the
Winning Bidder, here in after known as Mare Owner.
Minimum opening Bid: This will be a silent auction. The minimum opening bid will be set at $350.00. Bids to be mailed to the South Central Region Chairperson to arrive by May 31, 2005. The winning bidder will be notified the first week of June. Upon receiving a check for the amount bid, payable to the IDHS(NA), and a contract signed with Mr. McGinty, arrangements for shipping the semen can be made with Mr. McGinty. If the payment is not received, the frozen semen breeding will be offered to the next highest bidder. In case of a tie, both parties will be notified and offered a chance to increase their bid.
Shipping: The Semen Owner will ship the semen at the Mare Owner’s expense with no additional charges for the collection, freezing, or storage of the said Semen.
Conditions of Ownership:
1. The mare owner represents and warrants that due to scarcity of Silver Granite Frozen semen, that No Live Foal Guarantee is offered with this Semen Auction.
2. The mare owner further represents that he/she is the owner or Lessee of record of the Mare.
3. The mare owner acknowledges that he/she should use the services of a Veterinarian specializing in Equine Reproduction with a proven record of success in breeding with frozen equine semen.
4. The mare owner further states that he/she should have a mare in sound breeding condition, confirmed by appropriate veterinary procedures to ensure the mare’s ability to conceive and carry a foal.
5. The mare owner should also be aware that he/she will be billed by their own veterinarian for reproductive services associated with the use of frozen semen such as palpations, sonograms, drugs or hormones, and insemination fees. It is the mare owner’s responsibility to obtain an estimate from the veterinarian for these services.
6. The semen owner represents and warrants that the semen offered in this Auction is the same 1994 collection that Carolyn Farrington used to breed her Irish Draught Sport Horse, “Book of Kells”.
7. The semen owner further states that semen from the
same tank stored in College Station , TX, was used in the spring of 2004 ( 10
years later) by Cynthia Lurix of Brookshire, TX to successfully impregnate her
RID mare.
Waiver of Liability
The Semen Owner can see no reason to believe that the frozen semen will not be successful. However, if the mare fails to settle in foal for any reason, the Semen Owner, The IDHS(NA), The IDHS(NA)-South Central Region, and Mr. Fintan Flannery, the current owner of Silver Granite shall be held blameless. It is further understood that the Semen Owner and above mentioned IDHS(NA), IDHS(NA)-SCR, and Mr. Flannery shall not be liable for any sickness, disability, or death of mare owner’s mare.
Breeder’s Certificate and Registration
One Breeder’s Certificate will be signed by the Semen Owner upon notification of the birth of a live foal. The foal from said breeding shall be eligible for IDHS(NA) progeny record subject to DNA typing, payment of fees, and presentation of paperwork as required from the IDHS(NA). Upon completion of progeny record requirements, and attaining the correct age, the foal will be eligible to be inspected for the appropriate Stud Book maintained by the IDHS(NA).
Entire Agreement
This contract constitutes the entire agreement between the parties concerning the Breeding of Silver Granite ( Frozen Semen ) and the “ Winning Bidder” ( Mare Owner)

This is a silent auction. Bids will be accepted by mail opening at $350.00. The bidder must submit their bid using this form by May 31, 2005. In the event of a tie, the tied bidders will be notified the first week of November and given the chance to increase their bid in increments of $25.00.
